Terms and Conditions
Last updated September 2026. These terms govern use of the Verachek website and screening service operated by Substantia Regulatory ("Verachek", "we").
1. The service
Verachek is an automated regulatory screening service. It compares substance information you submit, by declaration or by upload of a Safety Data Sheet, against a curated knowledge base of EU chemical regulations and returns a screening verdict and report. The service is provided as described on the How it works and Regulations pages, within the scope stated there.
2. Not legal advice
Verachek is a screening aid. Its output does not constitute legal advice, a legal opinion, a certification, a test result or a guarantee of compliance. You remain solely responsible for compliance with REACH, RoHS, the POPs Regulation and every other law applicable to your products, including any duty to communicate, notify, register or restrict. You should obtain professional advice before relying on a verdict for any regulatory, contractual or commercial decision.
3. Accounts and acceptable use
You must provide accurate account information and keep your credentials confidential. You may use the service only for lawful purposes and only for products for which you hold the relevant data. You may not resell or white-label the service except under a separate reseller agreement, attempt to reverse-engineer the knowledge base or screening logic, submit content you have no right to submit, or use automated means to exceed the limits of your plan. The free check is limited to one screening per organisation.
4. Plans, fees and cancellation
Fees are shown on the pricing page and exclude VAT. Pay-per-report purchases are charged at purchase. Subscriptions are billed in advance per month or year and renew automatically until cancelled; cancellation takes effect at the end of the current billing period. Report allowances do not roll over. Payment is processed by our payment provider under its own terms.
5. Your data and content
You retain all rights in the SDS files, substance data and other content you submit. You grant us a licence to process it to provide the service, including automated extraction, screening, human review, report generation and storage in your workspace. Our handling of personal data is described in the Privacy Policy; business customers may enter into our Data Processing Agreement.
6. Our intellectual property
The service, the knowledge base, the screening logic, report templates and the Verachek name and mark are our property or that of our licensors. Reports are provided for your internal use and for communication with your customers, suppliers and authorities; you may not remove the Verachek attribution or disclaimer from a report.
7. Availability and changes
We aim for high availability but do not guarantee uninterrupted service. We may update the knowledge base, features and these terms; material changes to the terms will be notified to account holders at least 30 days before they take effect. The knowledge base is versioned and every report states the version used.
8. Warranties and limitation of liability
The service is provided "as is". To the fullest extent permitted by law we exclude all implied warranties, including accuracy, completeness and fitness for a particular purpose. Regulatory lists change and source data may contain errors; we do not warrant that a verdict is free of error or that it reflects every obligation applicable to your product. To the extent permitted by law, our total aggregate liability arising out of or in connection with the service in any twelve-month period is limited to the fees you paid to us in that period, and we are not liable for indirect or consequential loss, loss of profit, fines, penalties, recalls or loss of business. Nothing in these terms limits liability for death, personal injury, fraud, or any liability that cannot be limited under applicable law.
9. Termination
You may close your account at any time. We may suspend or terminate access for breach of these terms or non-payment. On closure you may export your reports for 30 days, after which your workspace data is deleted in accordance with the Privacy Policy.
10. Governing law
These terms are governed by the laws of the Federal Republic of Germany. Courts of Augsburg have exclusive jurisdiction, without prejudice to mandatory consumer-protection rules where they apply.
